Water Service Licenses and Infrastructure in the Saudi Water Law
رخص خدمات المياه والبنى الأساسية — نظام المياه
The Authority's licenses for service provision; no assignment of a license or assets, or merger, without its approval; continuity of service and asset transfer on liquidation or bankruptcy; water harvesting infrastructure; the ban on drilling in protected zones of infrastructure, wells and dams; preventing leaks outside buildings; and inspectors' access.

- Article 47
The article makes issuing, renewing and amending licenses, exemptions and permits for service provision activities the Authority's responsibility, and bans carrying out any of these activities without a license except those exempted by the Authority's regulations.
1- تتولى الهيئة إصدار الرخص، والإعفاءات، والتصاريح اللازمة لمزاولة أي نشاط من أنشطة تقديم الخدمة، أو الإعداد لمزاولته، وتجديدها، وتعديلها. 2- فيما عدا الأنشطة المعفاة من الرخصة أو بعض شروطها التي تحددها لوائح الهيئة؛ لا يجوز القيام بأي نشاط من أنشطة تقديم الخدمة إلا بعد الحصول على الرخصة اللازمة.
- Article 48
The article prohibits a licensee for a service provision activity from assigning its license or disposing of the licensed assets in any way before obtaining the Authority's written permission, without affecting the performance of the activity.
لا يجوز للمرخَّص له بنشاط تقديم الخدمة -قبل الحصول على إذن مكتوب من الهيئة- التنازل عن رخصته، أو التصرف في الأصول المرخَّص لها، سواءً بالنقل، أو البيع، أو الرهن، أو أي تصرف آخر، وتحدد لوائح الهيئة الشروط الخاصة بذلك، على ألا يترتب على أي من هذه التصرفات إخلال بأداء النشاط المرخَّص به.
- Article 49
Article 49 requires a service-activity licensee to get the Authority's approval before merging with others or acquiring most of their shares or assets, and to notify the Authority of any preliminary agreement.
يجب على المرخَّص له بنشاط تقديم الخدمة الحصول على موافقة الهيئة قبل الاندماج مع أشخاص آخرين، أو امتلاك معظم حصصهم، أو موجوداتهم، ويجب عليه إشعار الهيئة بأي اتفاق مبدئي يتم التوصل إليه في هذا الشأن.
- Article 50
Article 50 requires the Authority, in coordination with the Ministry, to make the necessary arrangements to ensure service continues if a service-activity licensee is unable to carry out its activity for any reason.
إذا تعذر على المرخَّص له بنشاط تقديم الخدمة القيام بنشاطه المرخَّص له به لأي سبب، فعلى الهيئة -وبالتنسيق مع الوزارة- اتخاذ الترتيبات اللازمة؛ لضمان استمرار تقديم الخدمة، وذلك وفقًا لما تحدده لوائح الهيئة.
- Article 51
Article 51 gives the Authority's inspectors the right to enter sites and facilities licensed by the Authority to check compliance with the Law, and allows the Authority to coordinate with the competent bodies if they are prevented or obstructed.
1- لمفتشي الهيئة الحق في دخول المواقع والمنشآت المرخَّص لها من قبل الهيئة؛ للتأكد من مدى الالتزام بتطبيق أحكام النظام. 2- في حال منع أو إعاقة مفتشي الهيئة عن تأدية أعمالهم، فللهيئة التنسيق مع الجهات المختصة؛ لاتخاذ الإجراءات اللازمة؛ لإتمام عملية الدخول، والتأكد من الالتزام بتطبيق أحكام النظام.
- Article 52
Article 52 tasks the Ministry or its delegate with building water harvesting infrastructure and networks outside the jurisdiction of the secretariats, municipalities and special zones when there is no licensee, and treats public water infrastructure as state property.
1- تقوم الوزارة أو من تفوضه في حال عدم وجود مرخَّص له في المناطق الواقعة خارج نطاق اختصاص الأمانات والبلديات والمناطق الخاصة؛ بإنشاء بنى أساسية، وشبكات، وأنظمة ذات كفاءة عالية؛ لحصاد المياه، وتوجيهها بما يحقق الاستفادة القصوى منها. 2- تُعد البنى الأساسية للمياه اللازمة لأنشطة تقديم الخدمة التي ينشئها القطاع العام…
- Article 53
Article 53 places everything relating to water infrastructure used in service-provision activities, including sale or otherwise, under the Authority's supervision, whoever owns it.
يخضع جميع ما يتعلق بالبنى الأساسية للمياه المستخدمة في أنشطة تقديم الخدمة من بيع أو غيره -سواء المملوكة للقطاع العام أو الخاص أو شراكة بين القطاعين- لإشراف الهيئة؛ وفق أحكام النظام ولوائح الهيئة.
- Article 54
If a licensee cannot carry out its activity and wishes to liquidate, or liquidation proceedings are opened under the Bankruptcy Law, it must coordinate with the Authority to transfer its assets at a fair value to the Ministry or another licensee.
إذا تعذّر على المرخَّص له بنشاط تقديم الخدمة القيام بنشاطه المرخَّص له به لأي سبب، ورغب في تصفية نشاطه؛ أو أفتتح له أي من إجراءات التصفية وفقًا لنظام الإفلاس، فيجب عليه التنسيق مع الهيئة؛ لنقل ملكية الأصول -بقيمة عادلة تعتمدها الهيئة- إلى الوزارة، أو إلى مرخَّص له آخر يتم اختياره وفقًا لما تحدده لوائح الهيئة.
- Article 55
Article 55 requires the licensee, except in special zones, to prepare water infrastructure plans for the Ministry's approval, and requires government and private bodies to coordinate with the Ministry to avoid threatening the infrastructure's safety.
1- فيما عدا المناطق الخاصة، يقوم المرخَّص له بإعداد مخططات للبنى الأساسية للمياه، وتعتمدها الوزارة. 2- على الجهات الحكومية والخاصة التنسيق مع الوزارة؛ لتفادي القيام بأي عمل من شأنه تهديد سلامة البنى الأساسية للمياه، أو التسبب في إتلافها، أو تلوثها.
- Article 56
Article 56 prohibits work or digging within the boundaries or protective zones of infrastructure and water plants without coordinating with the licensee or owners, and within those of wells and dams without coordinating with the Ministry.

- Article 57
Article 57 prohibits water from flowing outside the boundaries of public and private buildings, or leaking from tanks, internal networks or water tankers, as the Authority's regulations specify.
يُمنع تدفق المياه خارج حدود المباني العامة والخاصة، أو تسربها من الخزانات أو الشبكات الداخلية أو الصهاريج، وفقًا لما تحدده لوائح الهيئة.
- Article 17
The article bars the relevant bodies from issuing licenses or approvals for any facility that may obstruct the use of surface water except with the Ministry's prior approval.
على الجهات المعنية عدم إصدار رخص أو موافقات على إقامة أيّ منشأة قد تعوق استخدام المياه السطحية إلا بموافقة مسبقة من الوزارة.
- Article 76
Article 76 specifies who issues the Implementing Regulations of the Water Law within 90 days of its publication, and lists the regulations the Authority issues for its regulatory tasks.
