Article 17 explained in plain English
This article places a restriction on the bodies concerned with issuing licenses and approvals:
- What is prohibited: issuing licenses or approvals to establish any facility.
- The condition: the facility may obstruct the use of surface water.
- The exception: if the Ministry's prior approval has been obtained.
The addressee of this rule is the relevant bodies that issue licenses and approvals, not the facility owner directly. But its effect reaches the facility owner: he should not obtain the license if his facility may obstruct the use of surface water without the Ministry's prior approval.
The phrase "may obstruct" covers the possibility of obstruction, so the text does not require the obstruction to be certain. The text does not set criteria for assessing this.
It is preceded by Article 16, which requires a license for agricultural water supply activities. It is followed by Article 18, which gives the Minister the right to suspend source use licenses or reduce their quantities for reasons of water scarcity, water, environmental or public health security.
To assess the effect of this rule on a particular case, it is advisable to consult a lawyer who specializes in water and environmental laws.
Practical example
An investor applied to build a warehouse on land near a surface watercourse in Asir. If the warehouse may obstruct the use of surface water, the relevant body may not issue the license except after the Ministry's prior approval.
