Article 24 explained in plain English
This article regulates the exchange of supervisory information between supervisory authorities in the Kingdom and their foreign counterparts, in implementation of paragraph (5) of Article (82) of the Law.
1. Information received from a foreign authority:
- If the supervisory authority obtains information from a foreign counterpart for supervisory purposes, it must obtain that authority's permission before passing the information on or using it.
- If the supervisory authority is obliged to disclose or report the information, it must tell the foreign authority of this obligation immediately.
2. Inquiries for the benefit of a foreign authority:
- The supervisory authority over financial institutions may make inquiries on behalf of foreign counterpart authorities.
- It may, if it sees an interest, authorize those authorities or facilitate for them making the inquiries themselves, for the purposes of consolidated supervision at the level of the financial group it supervises.
The practical meaning is that information exchanged between supervisory authorities is protected by the condition of permission, and that financial institutions belonging to international groups may be subject to inquiries made for a foreign supervisory authority or facilitated by it. The available text does not set out the content of paragraph (5) of Article 82 of the Law.
Financial institutions that receive inquiries of this kind may consult a lawyer specialized in banking and finance.
