Article 21 explained in plain English
This article deals with the controlled delivery of funds in terrorism and financing crimes, that is, allowing suspicious funds to pass under surveillance to reveal those connected with the crime:
- The competent authorities referred to in Article (72) of the Law: the Public Prosecution and the Presidency of State Security, each within its jurisdiction, with coordination, where appropriate, with the relevant bodies.
- The reference for execution: requests for controlled delivery of funds are executed according to the provisions of the "procedures for implementing the International Convention for the Suppression of the Financing of Terrorism". The article does not set out those procedures.
- The power of the Presidency of State Security: in the area of providing assistance in investigations, it may allow funds, proceeds or instrumentalities that are likely to be used in one of the crimes under the Law to pass into or through the territory of the Kingdom, for the purpose of identifying one or more persons connected with the commission of a crime under the Law.
The practical meaning is that not seizing suspicious funds as soon as they are discovered may be deliberate under this method, and that the purpose specified in paragraph 3 is to identify those connected with the crime. The available text does not set out Article 72 of the Law.
A person connected with funds that have been subject to procedures of this kind should consult a lawyer specialized in criminal or international cases.
