Article 25 explained in plain English
First: caring for the rights of victims and those in their position, referred to in paragraph (1) of Article (85) of the Law, which is done through:
- Making them aware of their rights.
- Providing assistance and support, including providing specialized lawyers to obtain those rights.
Second: protecting those covered in paragraph (2) of the same article, by one or more of the following measures:
- Providing personal protection.
- Providing temporary residence.
- Not disclosing information relating to identity.
- Assigning a telephone number for reporting when exposed to danger or harm.
- Subjecting means of communication to monitoring, after the written consent of the person under protection.
- Recommending his assignment to work elsewhere, after his written consent.
- Concealing the data of the witness or source in a way that prevents them from being identified.
The relevant bodies may take whatever other measures they see fit to ensure their safety.
The practical meaning is that some measures, such as monitoring communications and moving the place of work, are taken only with the written consent of the protected person, while more than one measure can be combined according to need. The available text does not set out who is covered in paragraphs (1) and (2) of Article 85 of the Law. A person who needs to know his rights as a victim or witness may consult a lawyer specialized in criminal cases.
Practical example
A witness in a terrorism case fears for his safety. His data can be concealed in a way that prevents him from being identified and a telephone number assigned to him for reporting danger, but his transfer to work elsewhere is recommended only after his written consent.
