Article 23 explained in plain English
This article regulates the work of the General Directorate of Financial Investigations on terrorism financing matters.
First: powers of the Directorate: it may take the procedures and measures necessary to perform its tasks, including:
- Using modern technologies and means.
- Preparing and updating the forms for reporting suspicious transactions used by financial institutions, the specified non-financial businesses and professions, and non-profit organizations.
The word "including" indicates that these are examples and not exhaustive.
Second: the duty of analysis: on receiving reports, information and records linked to terrorism financing, the Directorate must carry out two types of analysis:
- Operational analysis: using the available information and what can be obtained to identify particular targets, trace the path of specific activities or transactions, and determine the links between these targets and the potential proceeds of the crime.
- Strategic analysis: using the available information and what can be obtained, including data of other competent authorities, to identify patterns and trends of the crime of terrorism financing.
The difference between them is that the operational focuses on specific cases and targets, while the strategic focuses on the general picture and patterns. The practical meaning for establishments obliged to report is that they use the forms the Directorate prepares. A person who needs to understand reporting obligations may consult a lawyer specialized in banking and finance.
