Article 77 explained in plain English
This article brings together a number of violations punishable by a fine not exceeding SAR 50,000. It was amended by Royal Decree No. (M/67) dated 12/8/1442 AH, and the explanation here is of the text in force after the amendment.
The violations:
- Failing to submit to the Ministry a statement of the antiquities a person owns.
- Possessing an original, unregistered archaeological item.
- Possessing an antiquity that has no proof of lawful ownership.
- Selling, leasing or transferring ownership of an immovable antiquity or a classified urban heritage site without the Ministry's approval.
- Carrying on restoration of movable antiquities for commercial purposes without a license, or violating the license conditions.
- Carrying out maintenance or subdivision and partition in classified urban heritage buildings, districts and villages without the Ministry's approval.
- A museum restoring an archaeological item it owns that is registered in the antiquities register without the Ministry's approval.
- Carrying on museum operation without a license, or violating the license conditions.
- Obstructing the work of the Ministry's teams at antiquities and urban heritage sites.
The violations most relevant to individuals are those of possession: possessing an original, unregistered archaeological item, or possessing an antiquity without proof of lawful ownership, are each a separate violation. Anyone who keeps old items at home should therefore check that they are registered and that there is proof their ownership is lawful.
The violations also cover owners of classified heritage buildings who sell, lease or divide them without approval, and museums and their operators. The penalty is a fine only, with a maximum and no minimum.
Anyone facing a violation under this article would be wise to consult a lawyer who specializes in antiquities and urban heritage law.
Practical example
Salman keeps old silver coins at his home in Riyadh that he bought years ago without any document, and has not registered them. Possessing an antiquity that has no proof of lawful ownership, and possessing an original, unregistered archaeological item, are each violations punishable by a fine not exceeding SAR 50,000.
