Article 76 explained in plain English
This article punishes four acts with a fine. It was amended by Royal Decree No. (M/67) dated 12/8/1442 AH, and the explanation here is of the text in force after the amendment.
The penalty: a fine not exceeding SAR 60,000, with no imprisonment.
The punishable acts:
- Possessing or making models or copies of antiquities for commercial purposes without a license from the Ministry.
- Concealing antiquities that the person has discovered or found, or refusing to hand them over to the Ministry.
- Exporting, selling or otherwise disposing of a movable antiquity in violation of the provisions of the Law and its regulations.
- Placing signs or boards or other advertising markers at antiquities and urban heritage sites without the Ministry's approval.
Note that the first paragraph covers possession as well as making; someone who possesses copies of antiquities for commercial purposes without a license, for example by offering them for sale, falls within the rule even if he did not make them himself.
The second paragraph concerns someone who discovers antiquities or finds them and then conceals them or refuses to hand them over. The third paragraph is broad, as it covers any disposal of a movable antiquity that violates the provisions of the Law and its regulations.
This article sits between Article 75 (a fine of up to SAR 70,000) and Article 77 (a fine of up to SAR 50,000). Anyone facing a violation under it would be wise to consult a lawyer who specializes in criminal cases.
Practical example
A farmer in Al-Qassim found an old pottery jar while plowing his land, kept it at home and told no one. Concealing the antiquity he found, or refusing to hand it over, exposes him to a fine not exceeding SAR 60,000.
