Article 74 explained in plain English
This article punishes acts that affect the integrity and appearance of antiquities and urban heritage. It was amended by Royal Decree No. (M/67) dated 12/8/1442 AH, and the explanation here is of the text in force after the amendment.
The penalty: imprisonment not exceeding 1 year, and a fine not exceeding SAR 100,000, or either of these penalties.
The punishable acts:
- Altering an urban heritage building or site, or modifying its surrounding environment in a way that harms it, without the Ministry's approval.
- Removing rubble, stones or soil from antiquities and urban heritage sites without the Ministry's approval.
- Dumping rubble or waste at antiquities and urban heritage sites.
- Defacing an antiquity or urban heritage by writing, painting or carving on it, pasting advertisements on it, or setting fire to it.
Note that the first and second paragraphs are tied to not obtaining the Ministry's approval, while the third and fourth mention no approval, so the act is punishable in itself.
The fourth paragraph relates to common behavior, such as commemorative writing on archaeological rocks or the walls of old buildings; such writing is punishable defacing. Dumping waste at archaeological sites, even if it seems a minor act, also falls among the punishable acts.
This article comes after Article 73, with its heavier penalties, and before Article 75, which is limited to a fine. Anyone facing an accusation under it would be wise to consult a lawyer who specializes in criminal cases.
Practical example
A group of young men wrote their names in paint on a rock bearing archaeological inscriptions in the Hail region during a desert trip. This is defacing an antiquity by writing and paint, punishable by imprisonment not exceeding 1 year and a fine not exceeding SAR 100,000, or either.
