Article 73 explained in plain English
This article punishes four acts. It was amended by Royal Decree No. (M/67) dated 12/8/1442 AH, and the explanation here is of the text in force after the amendment.
The penalty: imprisonment not exceeding 2 years, and a fine not exceeding SAR 200,000, or either of these penalties. The text sets no minimum penalty.
The punishable acts:
- Imitating or forging an antiquity while claiming it is archaeological; that is, making a copy and claiming it is an original antiquity. The decisive element is the claim of archaeological status.
- Carrying out any total or partial demolition within the boundaries of antiquities and urban heritage sites, or building on them, without obtaining the Ministry's approval.
- Violating the conditions and rights of the easement imposed on land adjoining an antiquities site.
- Deliberately salvaging a submerged antiquity, or moving it from its place.
Note the word "deliberately" in the fourth paragraph; the penalty concerns intentional salvage. Note also that the text in force refers to the approval of "the Ministry" in the second paragraph.
The difference between the first paragraph and licensed copying of antiquities is that what is punished here is imitating or forging while claiming that the item is archaeological.
This article comes after Article 72, which punishes interference with antiquities and excavation without a license with more severe penalties, and before Article 74, with lighter penalties. Anyone facing an accusation under it would be wise to consult a lawyer who specializes in criminal cases.
Practical example
A person displayed a recently made statue at a popular market in Jeddah as an old archaeological piece to sell at a high price. This act amounts to imitating or forging an antiquity while claiming it is archaeological, punishable by imprisonment not exceeding 2 years and a fine not exceeding SAR 200,000, or either.
