Article 72 explained in plain English
This article punishes two forms of attack on antiquities. It was amended by Royal Decree No. (M/67) dated 12/8/1442 AH, and the explanation here is of the text in force after the amendment.
The penalty:
- Imprisonment: not less than 3 months and not more than 3 years.
- Fine: not less than SAR 20,000 and not more than SAR 300,000.
- Or either of these penalties.
The punishable acts:
- Interfering with an antiquity, archaeological site or urban heritage site, in one of the following ways: destroying it, altering it, removing it, digging it up, damaging it, changing its features, or obliterating it.
- Surveying or excavating for antiquities without a license.
The second form matters in practice, because some people dig at ancient sites looking for what they think are treasures; this act falls within excavation without a license punished here. Under Article 1, excavation covers all digging, probing, investigation and diving aimed at finding antiquities, and archaeological survey covers exploring and documenting antiquities sites.
This article comes after Article 71, which punishes more severely the unlawful taking of State antiquities, and before Article 73, which punishes other acts such as forging antiquities and demolishing or building without approval. Anyone facing an accusation under this article would be wise to consult a lawyer who specializes in criminal cases.
Practical example
Two people are caught digging at night at an archaeological site in the north of the Kingdom, with metal detectors, looking for old items, without a license. This act amounts to excavating for antiquities without a license, punishable by imprisonment from 3 months to 3 years and a fine of SAR 20,000 to SAR 300,000, or either.
