Article 13 explained in plain English
After approval of the application, the stage of identifying the workers by name follows. This article provides that the visa applicant submits to the Kingdom's missions:
- Lists of the workers' names and data.
The text requires that these workers have been tested and selected by the visa applicant itself or its representative, and that this be done in accordance with the relevant requirements, regulations and instructions. The responsibility for selecting suitable workers therefore rests on the establishment.
These lists have a direct role in Article 15, under which the missions approve visas according to the submitted lists after verifying that the workers meet the technical and professional requirements under paragraph 2 of Article 8. Including a worker who does not meet the requirements may therefore prevent approval of his visa.
Anyone who needs to assess their establishment's obligations at this stage may consult a lawyer specializing in recruitment and visa regulations.
