Article 14 explained in plain English
This article deals with baggage in three paragraphs:
1- Inspection: the carrier or the person responsible for the transport facilities may inspect passengers' baggage, and if necessary empty its contents to inspect them, in cases that require it and for security and safety purposes. The inspection is therefore limited to that purpose.
2- Baggage report: the carrier must prepare a report on the condition of any baggage that is lost, damaged or delayed, stating:
- the condition of the baggage.
- the cause of the loss, damage or delay.
- its date.
The report is prepared in the passenger's presence if possible, and the passenger is given a copy of it. The passenger may object to the content of the report and request an expert's opinion.
3- When is baggage considered lost? If it is not delivered to the passenger within fourteen days of the date it is claimed. The period runs from the date of the claim, not from the date of the trip.
The importance of the third paragraph is that it settles when a delay becomes a loss.
Article 13 provides that the carrier is responsible for baggage handed over to it from the time it receives it until it delivers it to the passenger, and must compensate the passenger for its loss, damage or late arrival. Article 15 regulates submitting a complaint to the carrier within thirty days of the date set for providing the service.
Anyone with an actual problem with a carrier would be well advised to consult a lawyer specializing in civil cases and compensation.
Practical example
Hind traveled by bus from Taif to Riyadh and handed her bag to the bus luggage compartment, but did not find it on arrival. She claimed it the same day, and the carrier prepared a report in her presence and gave her a copy. If the bag is not delivered to her within 14 days of the date of the claim, it is considered lost.
