Article 13 explained in plain English
This article regulates the carrier's responsibility in four paragraphs:
1- Compensating damage: the carrier must compensate for damage resulting from its errors and those of its subordinates that affect passengers or third parties, if the damage arises from an error that occurred during the provision of the service or because of it. Under Article 1, a third party is anyone who visits the transport facilities or the means of transport who is not a passenger or an employee.
2- Medical assistance: the carrier must in all cases take the immediate steps needed to provide medical assistance and bear the treatment costs for a passenger injured during the provision of the service. These costs are not counted in calculating the amount of compensation mentioned in paragraph (1), meaning they are added to it and not deducted from it.
3- Baggage: the carrier is responsible for baggage handed over to it, from the time it receives it until it delivers it to the passenger, and must compensate the passenger for its loss, damage or late arrival.
4- Exemption: the carrier is exempt from the responsibility and compensation provided for in this article if the damage results from an unlawful act, or fault or negligence on the part of the passenger, or from force majeure.
Note that responsibility for baggage relates to baggage handed over to the carrier, such as bags placed in the bus luggage compartment, not everything the passenger carries.
Article 12 sets out the carrier's other obligations, such as the complaints register and multiple payment options. Article 14 regulates the inspection of baggage and the report on the condition of lost or damaged baggage, and baggage is considered lost if it is not delivered to the passenger within fourteen days of the date it is claimed.
Anyone with an actual problem with a carrier would be well advised to consult a lawyer specializing in civil cases and compensation.
Practical example
A bus between Riyadh and Qassim stopped suddenly because of the driver's error, and a passenger was injured. Under this article, the carrier must take immediate steps to provide medical assistance and bear the cost of treatment, in addition to compensating the passenger for the damage resulting from the driver's error, and the treatment costs are not counted as part of the compensation.
