Article 15 explained in plain English
This article sets out the complaint path with specific deadlines:
- Submitting the complaint: the passenger submits it to the carrier within thirty days of the date set for providing the service.
- Acknowledgment of receipt: the carrier issues an acknowledgment of receipt of each complaint stating its date, within five working days of receiving it.
- Notification: the carrier notifies the passenger within fifteen working days of receiving the complaint that it is under consideration, or that it is accepted or rejected with the reasons. In all cases, the handling period may not exceed thirty days from the date of receipt.
- Objection: if the passenger is not satisfied with the handling, or the carrier exceeds the specified period, the passenger has the right to object before the committee formed under Article 17, within sixty days of the date of being notified of the result of the handling, or of the date the handling period ends.
Note the difference between "working days" in paragraphs 2 and 3 and "days" in the other paragraphs.
Under Article 17, the committee is formed by a decision of the Board of five members nominated by the Chairman, including two legal advisers, one of whom is named chair, and three persons with technical expertise, and it hears passengers' objections to the result of the handling of complaints. Its decisions are issued by majority and with reasons, and they may be appealed before the Board of Grievances within sixty days of being notified of them.
Article 14 treats baggage as lost if not delivered within fourteen days of the claim, and Article 16 makes the Authority the supervisor of the implementation of the Regulation.
Anyone with an actual problem with a carrier would be well advised to consult a lawyer specializing in civil cases and compensation.
Practical example
A train that Sultan traveled on was delayed three hours, so he submitted a complaint to the carrier a week after the trip. The carrier issued an acknowledgment of receipt within five working days, but did not handle the complaint within thirty days. Sultan has the right to object before the committee within sixty days of the date the handling period ended.
