Article 9 explained in plain English
This Article parallels Article 8, but concerns requests rather than the claim:
- Assessing authority: the competent department specified by the Minister of Justice.
- Timing: it issues the final assessment of the costs of the request after it is decided.
- Notification: the person obligated to pay the costs is notified.
- Collection: the amount is collected only after the period for objecting to the assessment ends or a decision is issued on the objection.
The exception: this provision does not apply to a cassation request or a petition for reconsideration. The Article does not say what rule applies to them, so the Law and the decisions issued under it must be consulted, and it cannot be assumed from this text alone that they are paid in advance or afterwards.
This Article covers requests such as appeal, incidental request, recusal request and others whose costs are set in Articles 6 and 7. Objection procedures are regulated under Article 14.
Anyone filing a cassation request or a petition for reconsideration who wants to know when and how their costs are collected should consider consulting a lawyer specializing in litigation and procedure.
