Final Assessment and Collection of Costs in the Saudi Judicial Costs Implementing Regulations

The Article provides that the competent department, set by the Minister of Justice, issues the final assessment of a claim's costs after it ends and notifies the obligated person; the amount is collected only after the objection period ends or the objection is decided.

تصدر الإدارة المختصة -التي يحددها وزير العدل- التقدير النهائي لمبلغ التكاليف القضائية للدعوى بعد انتهائها، ويبلغ المكلف بأداء هذه التكاليف، ولا يُحصل مبلغ التكاليف من المكلف إلا بعد انتهاء مدة الاعتراض على التقدير أو صدور قرار في شأن اعتراضه.

The Article provides that, except for cassation and petitions for reconsideration, the final assessment of a request's costs is issued after it is decided and collected only after the objection period ends or the objection is decided.

فيما عدا طلب النقض وطلب التماس إعادة النظر، تصدر الإدارة المختصة -التي يحددها وزير العدل- التقدير النهائي لمبلغ التكاليف القضائية للطلب بعد البت فيه، ويبلغ المكلف بأداء هذه التكاليف، ولا يُحصل مبلغ التكاليف من المكلف إلا بعد انتهاء مدة الاعتراض على التقدير أو صدور قرار في شأن اعتراضه.

The Article provides that judicial costs are calculated in Saudi riyals and that any fraction of a riyal is not counted in assessing them.

تحتسب التكاليف القضائية بالريال السعودي، ولا يحتسب الجزء من الريال في تقدير التكاليف.

Article 12 provides that judicial costs are collected in accordance with the applicable legal provisions.

يكون تحصيل التكاليف القضائية وفق الأحكام النظامية المقررة.

Article 13 requires the Ministry of Justice to open a current account for collected judicial costs, to manage collection, objections and exemptions, and then deposit them in the Ministry of Finance's account at the Central Bank.

لغرض إدارة التحصيل والاعتراضات والإعفاءات والاستثناءات الواردة في النظام واللائحة؛ تفتح وزارة العدل حساباً جارياً تودع فيه المبالغ المتحصلة من التكاليف القضائية، ومن ثم تُودع تلك المبالغ في حساب جاري وزارة المالية لدى البنك المركزي السعودي.

Article 14 authorizes the Minister of Justice, in coordination with the President of the Supreme Judicial Council, to issue what is needed on the procedures for objecting to the competent department's decision setting the amount of judicial costs.

يصدر وزير العدل بالتنسيق مع رئيس المجلس الأعلى للقضاء ما يلزم في شأن إجراءات الاعتراض على قرار الإدارة المختصة بتحديد مبلغ التكاليف القضائية.

Article 15 provides that the procedures of the Law and the Regulations are carried out at any time by approved electronic means, and may be carried out by ordinary means if that is not possible.

يكون تنفيذ الإجراءات الواردة في النظام واللائحة في أي وقت باستعمال الوسائل الإلكترونية المعتمدة، وإذا تعذر تنفيذ أي من الإجراءات بالوسائل الإلكترونية المعتمدة، فيجوز تنفيذه بالطرق العادية.
