Article 8 explained in plain English
This Article answers an important question: when are costs finally determined, and when are they collected?
- Assessing authority: the competent department specified by the Minister of Justice.
- Timing of the final assessment: after the claim ends.
- Notification: the person obligated to pay the costs is notified of the assessment.
- Collection: the amount is collected from the obligated person only after:
- the period for objecting to the assessment has ended, or
- a decision has been issued on the person's objection, if they objected.
The obligated person therefore has an opportunity to object to the assessment before the amount is collected. This Article does not set the objection period; as for its procedures, the Minister of Justice issues them in coordination with the President of the Supreme Judicial Council under Article 14.
The Article does not say who the person obligated to pay is; for that the Law must be consulted. Article 9 sets a similar provision for requests, and amounts collected are deposited in the account described in Article 13.
Anyone who has received an assessment of costs that they believe is incorrect should consider consulting a lawyer specializing in litigation and procedure before the objection period ends.
Practical example
A commercial claim between two companies in Dammam has ended, and the competent department issued the final assessment of costs and notified the company obligated to pay them. The company considered the assessment too high and objected, so the amount is not collected from it until a decision is issued on its objection.
