Article 80 explained in plain English
This article of the Regulations, in the chapter on the right to object to judgments and decisions, deals with two cases in which an objection before the court of appeal is permitted.
Who may object? Any interested person, so the right is not limited to the debtor or a creditor.
What may be objected to? A court judgment or decision whose subject is one of two matters:
- The joint liability of owners under paragraph 2 of Article 120 of the Bankruptcy Law.
- Transactions that can be annulled under Chapter Thirteen of the Bankruptcy Law.
Note that the article mentions the two subjects by reference to the Law without explaining the content of paragraph 2 of Article 120 or the provisions of Chapter Thirteen, which should be consulted in the Law to know when the joint liability of owners arises or when a transaction can be annulled.
The article also does not specify the period for objecting, its procedures or its effect on carrying out the judgment or decision, which are matters referred to the Bankruptcy Law and the rules issued under it.
Because the dates and procedures for objecting are delicate matters, anyone against whom a judgment or decision affecting his interest has been issued is advised to consult a lawyer who specializes in bankruptcy and commercial cases.
Practical example
A court decision was issued annulling a transaction made by a struggling company in Riyadh with another party, under Chapter Thirteen of the Law. The other party, as an interested person, may object to this decision before the court of appeal.
