Article 13 explained in plain English
This article of the Implementing Regulations of the Bankruptcy Law explains how a creditor claims his right in a bankruptcy procedure, and sets three elements:
- The recipient: the claim is submitted to the trustee or to the Bankruptcy Committee. The article does not specify when the recipient is the trustee and when it is the Bankruptcy Committee, but Article 14 makes the review of claims the task of the trustee or the Bankruptcy Committee "according to the procedure."
- The period: within the period specified for submitting claims. This article does not state the length of this period.
- The form: in the form specified for this purpose.
What happens after submission? Under Article 14, the trustee or the Bankruptcy Committee reviews the claims and takes what is needed to verify their validity, their value and the information submitted to prove them, then prepares a list of claims that is submitted to the court for approval within 14 days of the end of the period specified for submitting claims. The list includes a recommendation to accept each claim, reject it, or refer it to an expert.
Practical advice: the creditor should follow the period specified for submitting claims, use the specified form, and attach what proves his claim and its value, because the review covers the information submitted to prove it.
This article does not state the effect of submitting a claim after the period has ended. Anyone who has missed the period or has a complex claim would do well to consult a lawyer specializing in bankruptcy cases.
Practical example
A building materials supplier in Dammam is owed an amount by a contracting company for which a bankruptcy procedure has been opened. He must submit his claim to the trustee or the Bankruptcy Committee, as the procedure requires, within the period specified for submitting claims, using the specified form, attaching the invoices and what proves the value of his debt.
