Article 30 explained in plain English
This article of the Implementing Regulations of the Bankruptcy Law deals with the case of a creditor who finds its own property (the very property it owns) still with the debtor, such as a seller who delivered goods and did not receive the price.
When does the court consider the request? During the period of the stay of claims.
Cases in which the court orders return of the very property:
- The property remains as it was: If the property has not changed by increase, decrease, modification or mixing with other property in a way that changes its nature.
- The price was not received: If the creditor has not received any part of the price of this property. The text says "any part".
- The period: If the creditor submits its request within 5 days of the date of the stay of claims.
The period is short: only 5 days from the date of the stay of claims, so a creditor who knows its property is still with the debtor should act promptly to submit its request.
What the article does not mention: It does not set out how the request is submitted, what rules follow the return of the property, or the position of a creditor whose property is not returned.
Relation to neighboring articles: Article 29 provides that membership of the creditors' committee does not stop the member from dealing with the debtor if the dealing is in good faith and at fair value. Article 31 regulates amendment of the plan, and allows the court to rule on a stay of claims if the reason for the amendment is the arising of a material circumstance.
Because the period is short and assessing whether the property has changed or remained as it was requires examination, the creditor is advised to consult a lawyer who specializes in bankruptcy and commercial cases as soon as it learns of the stay of claims.
Practical example
An appliance dealer in Riyadh sold a company 50 air conditioners on credit, did not receive any part of the price, and the units are still in the company's warehouse in their original condition, not installed or modified. A bankruptcy procedure was then opened for the company and the claims were stayed. The dealer can ask the court to return the very units, provided it submits its request within 5 days of the date of the stay of claims.
