Article 44 explained in plain English
This article of the Implementing Regulations of the Bankruptcy Law sets out an important right of the creditor and makes it a duty of the trustee: to allow the creditor to inspect the list of claims approved by the court.
The elements of the ruling are as follows:
- Person bound: The trustee.
- Beneficiary: The creditor.
- Subject of inspection: The list of claims after the court approves it, not any preliminary list.
The importance of this right is that through it the creditor can know where its claim stands among the other claims, and whether it was accepted in the approved list. The article does not specify the means or duration of inspection; its ruling is limited to obliging the trustee to allow it.
This article sits within the provisions on the financial reorganization procedure in the Regulations, after Article 43 on a request to recover assets and before Article 45, which requires the trustee to attach his report on the proposal when it is filed with the court.
If a creditor finds that its claim was not approved as it sees it, it is advisable to consult a lawyer who specializes in bankruptcy and commercial cases to learn the options available.
Practical example
Abdullah is a creditor of a company in the financial reorganization procedure and wants to confirm that his claim is included. He asks the trustee to inspect the list of claims approved by the court, and the trustee must allow him to do so.
