Article 11 explained in plain English
Article 11 deals with an emergency: damage to an advertising or publicity board because of:
- traffic accidents, such as a car hitting the board or its base.
- natural factors, such as wind or rain.
In these two cases the company or establishment carrying out the advertisement is bound to do two things:
- repair the board.
- remove the debris resulting from the accidents.
The time limit in the text is twofold: immediately, and within a period not exceeding 24 hours. So the rule is immediate action, with a maximum of twenty-four hours.
The text does not distinguish between damage caused by another party and damage caused by nature; the obligation to repair and remove debris falls on the company in both cases. The text does not address the company's recourse against the person who caused the accident, as that is outside the scope of this article.
This article complements Article 10, which makes the preparation of the sites and the facilities they need, with their maintenance and cleaning, the responsibility of the company or establishment carrying out the advertisement. Periodic maintenance is its responsibility under Article 10, and urgent repair after accidents is its responsibility under this article.
A person whose board has been damaged in an accident and who wishes to know his rights against the person who caused it may consult a lawyer specializing in civil cases and compensation.
Practical example
