Article 53 explained in plain English
This article specifies the body that considers a number of the less serious offenses in the Law, and gives the penalized person the right to complain. It contains the following provisions:
- Forming the committee: by decision of the Minister, who is the Minister of Interior, a committee of three members is formed, at least one of whom is qualified in Sharia or legal sciences.
- Its jurisdiction: considering the imposition of the penalties in Article 43 except paragraph (c), Article 44, Article 45 and Article 46.
- Approval of decisions: the Minister or his delegate approves the committee's decisions.
- Complaint: a person against whom a penalty decision has been issued may complain against it before the administrative court within sixty days of notification of it.
Note that paragraph (c) of Article 43 is excluded from the committee's jurisdiction, so under this text this committee does not consider it.
This article was amended by Royal Decree No. (M/17) dated 1/4/1437 AH to read as it now does.
It follows Article 52, which assigns investigation of the Law's offenses to the Bureau of Investigation and Public Prosecution. It is followed by Article 54, which provides that the Board of Grievances has jurisdiction to consider cases of violators and impose the penalties, without prejudice to what this article provides.
The period set for the complaint is important, so a person against whom a decision has been issued should promptly consult a lawyer specializing in administrative cases (the Board of Grievances).
Practical example
The committee issued a decision penalizing Ahmed with a fine for one of the offenses within its jurisdiction, and the Minister approved it. If Ahmed believes the decision is wrong, he may complain against it before the administrative court within sixty days of being notified of the decision.
