Article 43 explained in plain English
This article sets a financial penalty only, a fine not exceeding SAR 2,000, and applies it to five cases:
- (a) Anyone whose license for importing, selling and buying, repairing, or training has expired and who continued the licensed work without applying for renewal of the license within three months of its expiry.
- (b) Anyone whose license to carry or acquire was cancelled and who did not dispose of the weapon or hand it over within three months of the cancellation.
- (c) Anyone who smuggled training weapons with the intent of personal use, or possessed an air rifle without a license.
- (d) Anyone who learned of the loss, theft, or damage of his weapon and did not inform the competent authorities.
- (e) Anyone who violated any other provision of the Law and its Regulations that is not covered by the other penalties in it. This is a general paragraph covering what no penalty was specified for.
Under Article 1, air rifles and training weapons are shooting weapons without gunpowder whose projectile is fired by air pressure or a spring.
Paragraph (c) was amended by Royal Decree No. M/17 dated 1/4/1437 AH to its current text.
This article comes after Article 42 on the penalty for not reporting trade in or smuggling of weapons, and is followed by Article 44, which punishes with a fine of not more than SAR 1,000 anyone who carries his licensed weapon in prohibited places and at prohibited times. Anyone fined who wishes to know his options may consult a lawyer who specializes in administrative or criminal matters.
Practical example
Majed bought an air rifle for fun at his rest house in Al-Qassim without obtaining a license for it. Under paragraph (c), possessing it without a license is punishable by a fine not exceeding SAR 2,000.
