Article 50 explained in plain English
This article regulates what happens to the weapons and ammunition that are seized, and it applies in addition to the penalties in the Law. It contains four provisions:
- Confiscation by judicial ruling: all seized weapons, ammunition, and related equipment are confiscated. If the violation is smuggling, the means of transport used in it is also confiscated.
- Inability to bring proceedings: if the investigating authority cannot bring a criminal case against the possessor of the seized items, they pass to the State. But if there are strong indications that an accused person in their possession may appear or be reached, the investigating authority first orders them to be held for a period not exceeding three years.
- Acquittal or lapse of the case: if the court rules for non-conviction because of an impediment to criminal responsibility, or for the lapse of the case through a pardon or the death of the accused, the unlicensed seized items are dealt with under the second provision.
- Disposal of the seized items: the Minister, who is the Minister of Interior, issues a decision on disposing of the seized items that were confiscated or passed to the State.
This article was amended by Royal Decree No. M/17 dated 1/4/1437 AH to its current text.
It comes after Article 49, which applies the penalties, except imprisonment, to establishments, and is followed by Article 51, which requires aggravating the penalties in Articles 34, 35, and 36 if the violator is an employee of the bodies concerned with applying the Law. Anyone whose weapons were seized or whose car was confiscated may consult a lawyer who specializes in criminal matters.
Practical example
A car driven by a person at a border crossing is seized with smuggled weapons in it. In addition to the penalty for smuggling, the weapons and ammunition are confiscated by judicial ruling, and the car is also confiscated because it is the means of transport used in the smuggling.
