Article 22 explained in plain English
This Article regulates supervision and inspection of the Law's application, in three paragraphs:
1. Inspectors' powers and employers' obligations
- The application of the Law and the Implementing Regulations is monitored by inspectors of the Organization and the Ministry, each within its own remit.
- Employers and their representatives must enable inspectors to obtain the necessary information and documents, and to view the records relating to the nature of the work, the number of workers, their wages, and how those are calculated and paid.
- Any obstruction or hindering of inspectors while they work is subject to the penalties set for obstructing and hindering labor inspectors in the Labor Law. This Law does not state the amount of those penalties; they are found in the Labor Law.
2. Violation reports: inspectors submit their reports to the Organization or the Ministry, and the competent body takes the necessary steps to verify and investigate violations and whatever is required regarding them.
3. Duties of inspectors and employees: they must treat people well and keep confidential the information they see, and may not under any circumstances disclose it or pass it on to anyone other than the competent departments of the Organization or the Ministry; the body applies the necessary penalties under the laws to any of its employees who violates this.
The Article is connected to Article 5, which divides responsibilities between the two bodies. Anyone who is subject to an inspection or a violation and needs an opinion on their position should consult a lawyer specialized in social insurance.
Practical example
An inspector from the Organization visited a contracting company in Jeddah and asked to view the records of the number of workers and their wages. The company must allow this, and if it refused or hindered him, the penalties for hindering labor inspectors in the Labor Law would apply. In return, the inspector must keep confidential what he saw.
