Article 5 explained in plain English
This article regulates the division of roles between two bodies that coordinate together to apply the Law: the General Organization for Social Insurance and the Ministry (the Ministry of Labor, according to the definition in Article 1).
The Organization's powers:
- Registering subscribers and collecting contributions.
- Paying compensation to beneficiaries.
- Managing and investing the account dedicated to the Law.
- Checking conditions in Article 8: Saudi nationality, completing periods of work, having no income from a job or private activity, and not having reached 60; and cases of suspension in Article 15: death, having a monthly income from work, leaving the Kingdom, and reaching 60 with entitlement to a pension.
The Ministry's powers (or any public or private body it assigns):
- Registering subscribers who are out of work.
- Identifying training needs and providing them.
- Checking conditions in Article 8: not being dismissed for a reason attributable to the subscriber, not leaving work of their own will, being able to work, being registered with the Ministry, searching seriously, committing to training, and complying with the Ministry's instructions; and cases of suspension in Article 15: losing the ability to work, not remaining registered, ceasing to search seriously, not committing to training, and not complying with the instructions.
The practical benefit is that the subscriber deals with the Organization over subscription and payment of compensation, and with the Ministry over registering as unemployed, training and searching for work. Article 6 provides for a coordination committee between the two bodies.
Practical example
Fahd lost his job at a factory in Kharj because it closed. Fahd registers himself as unemployed with the Ministry, which checks that he did not leave work of his own will and that he is able to work and is looking for work, while the Organization checks his nationality, his period of work and that he has no income, and then pays him compensation if the conditions are met.
