Article 23 explained in plain English
This Article regulates the route for objecting to decisions of the General Organization for Social Insurance relating to its tasks in applying the Law.
Who may object? Employers, subscribers, and those who stand in their place.
To which decisions? Any decision issued by any competent department of the Organization relating to its tasks in applying the Law, which under Article 5 include registering subscribers, collecting contributions and paying compensation.
To whom is the objection submitted?
- To the Governor of the Organization, if the decision was issued by the office director.
- To the Board of Directors, if the decision was issued by the Governor.
If the objection is not accepted? Whoever's objection was not accepted may file a complaint before the judicial body competent to hear labor cases.
This Article sets no general deadline for submitting the objection. Article 24 deals with objecting to decisions of the Ministry, not the Organization. What matters is that the person concerned identifies which body issued the decision, because the route of objection differs accordingly.
Because how an objection and a complaint are drafted affects their outcome, the person concerned would do well to consult a lawyer specialized in social insurance.
Practical example
The director of the Organization's office in Riyadh refused Khaled's request for payment of compensation, considering that his work period was incomplete, but Khaled thinks otherwise. Khaled submits his objection to the Governor of the Organization, and if it is not accepted, he may file a complaint before the judicial body competent in labor cases.
