Article 5 explained in plain English
This article sets the conditions for imposing final measures and their forms:
1) Anti-dumping and countervailing measures: they may be imposed as final duties and by accepting price undertakings, after an investigation proves conclusively that the imports are dumped or subsidized and have caused or threaten to cause material injury to the domestic industry, or retard the establishment of a nascent domestic industry.
2) Safeguard measures: they may be imposed as final duties and quantitative restrictions, after an investigation proves conclusively that there is an increase in imports that has caused or threatens to cause serious injury to the domestic industry. The Implementing Regulations set the conditions for quantitative restrictions and how quotas are distributed.
3) Scope of application: final measures apply to the imports subject to them on the basis of the decision imposing them, and also retroactively to:
- Products subject to a provisional measures decision under Article 10, which provides for final measures to apply from the date of the provisional measures decision when positive final findings of injury are reached, with the difference refunded if the final duties are lower.
- Imports subject to registration and monitoring under paragraph (2) of Article 11, which allows, when the conditions in the Implementing Regulations are met, final measures to be imposed retroactively for a period not exceeding 90 days before the provisional measures decision and not earlier than the date the investigation began.
- Imports subject to registration under the Law when the conditions for final collection are met.
It is preceded by Article 4, which gives the decision to impose measures to the President on the basis of the Governor's recommendations, and followed by Article 6, which limits measures to the period and amount necessary. Anyone affected by these measures may consult a lawyer specialized in international matters and foreign investment.
Practical example
An investigation concludes that imports of a type of tire are dumped and have caused material injury to a Saudi factory. Final duties may be imposed on them, or price undertakings accepted from the exporters. If provisional measures were imposed during the investigation, the final measures apply retroactively under Article 10.
