Article 6 explained in plain English
This article sets out the principle of proportionality in measures and regulates how they are modified:
Paragraph 1 - limits of measures:
- Anti-dumping and countervailing measures are applied for the period and in the amount necessary to counter the dumping and the specific subsidy that is causing injury to the domestic industry, and no more.
- Safeguard measures are applied to the extent necessary to prevent or remedy serious injury, so as to enable the domestic industry to adjust.
Paragraph 2 - modifying measures:
- The level, form or scope of final measures may be modified on the basis of an interim review or an anti-circumvention review.
- In anti-dumping and countervailing investigations, a measure may be set for a new exporter after final measures are imposed, on the basis of a new exporter review.
Under Article 1, an interim review is conducted when there is a change in circumstances that calls for reviewing the level, scope or form of the measures, and a new exporter review is conducted at the request of an exporter that did not export during the investigation period and is not related to an exporter or producer that did export during it.
This article comes after Article 5, which sets the conditions for imposing final measures and their forms, and before Article 7, which sets their durations: five years for anti-dumping and countervailing measures, extendable through a final review, and an initial four years for safeguards, with a total, including extension, not exceeding ten years. Anyone who believes their circumstances have changed may consult a lawyer specialized in international matters and foreign investment.
Practical example
A foreign exporting company began exporting to the Kingdom after anti-dumping duties were imposed on a certain product. It was not exporting during the investigation and is not related to anyone who was. It can request a new exporter review so that a measure specific to it is set.
