Article 11 explained in plain English
This article regulates the timing of provisional measures:
1) Anti-dumping and countervailing:
- They are imposed only after at least 60 days have passed from the date the investigation began.
- Provisional anti-dumping measures: they may not continue for more than 4 months from being imposed, and this can be extended to 6 months if the investigation took steps to impose a measure lower than the dumping margin that is sufficient to remove the injury. Both periods may be extended, from 4 to 6 months and from 6 to 9 months, if exporters representing a significant percentage of the trade in the product so request.
- Provisional countervailing measures: they may not continue for more than 4 months.
2) Expanded retroactivity: when the conditions set out in the Implementing Regulations are met, final measures may be imposed retroactively on dumped or subsidized imports for a period not exceeding 90 days before the provisional measures decision, and not earlier than the date the investigation began. To carry this out, the Zakat, Tax and Customs Authority registers and monitors those imports at the request of the Authority and provides the necessary reports.
3) Provisional safeguards: they are imposed for a period not exceeding 200 days, during which the investigation procedures are completed and the final findings reached.
It comes after Article 10, which provides for final measures to be imposed retroactively from the date of the provisional measures when injury is established, and before Article 12, which regulates complaints and sets the investigation period at 12 months, extendable to 18 months, and provides that the investigation period must not exceed the period of provisional safeguards when they are imposed. Anyone whose imports are affected by these periods may consult a lawyer specialized in international matters and foreign investment.
Practical example
A dumping investigation into fabric imports began on the first of Muharram. Provisional duties may not be imposed until at least 60 days have passed from that date, and if imposed, they continue for no more than 4 months, unless exporters representing a significant percentage of the trade ask for this to be extended to 6 months.
