Article 4 explained in plain English
This article sets out "who does what" under the law:
- The Authority: carries out trade remedies work, including investigations, reviews and imposing measures, in line with the Kingdom's international commitments, in particular the agreements on anti-dumping, subsidies and countervailing measures, and safeguards.
- The Department: receives complaints and review requests, studies them and decides whether to accept or reject them, and forms the investigation teams. It may request, collect and keep confidential and non-confidential information, then studies it, issues reports and submits the results to the Governor.
- The Governor: decides to open investigations and to end them without measures, and opens reviews. He submits recommendations to the President to impose, extend, end or modify measures and to refund duties. He may also decide on registering and monitoring imports, import licenses and adding sub-items to the customs tariff, and may impose fines and consider grievances against them.
- The President: decides whether or not to impose provisional and final measures on the basis of the Governor's recommendations, and may reduce, extend, end or modify them and refund duties. He decides matters relating to the public interest, considers grievances from the parties concerned, and may form advisory committees and technical working teams.
- The relevant government bodies: provide the necessary information at the Authority's request and take the executive steps needed to apply the measures. The Authority, in turn, must give them what they need to carry out their tasks.
All of this is in accordance with the provisions of the Law and the Implementing Regulations. Under Article 1, the President is the chairman of the Authority's board. Article 5 follows, setting out when final measures may be imposed and what forms they take. Anyone wishing to file a complaint or follow an investigation may consult a lawyer specialized in international matters and foreign investment.
Practical example
A Saudi solar panel manufacturer files an anti-dumping complaint. The Department studies it and decides to accept it, then the Governor decides to open the investigation. The investigation teams do their work and submit the results to him, and he submits his recommendation to the President, who decides whether or not to impose measures.
