Article 10 explained in plain English
This article sets out what happens to provisional duties when the final findings are issued, and distinguishes two cases:
Case one - injury established (paragraph 1): if the investigation reaches positive final findings that imports are dumped or subsidized and have caused material injury, or that an increase in imports has caused or threatens to cause serious injury:
- Final measures are imposed retroactively from the date of the provisional measures decision.
- If the final duties are lower than the provisional ones, the difference is refunded.
- If the final duties are higher than the provisional ones, the difference is not collected.
Case two - only a threat of injury or retardation (paragraph 2): in anti-dumping and countervailing investigations, if the investigation concludes that the imports caused a threat of injury or material retardation of a nascent industry, and not material injury, provided this finding is not due to the effect of the provisional measures:
- Provisional duties are refunded and guarantees returned.
- Final measures are imposed from the date the decision imposing them takes effect, not retroactively.
This article complements Article 9, which allows provisional measures as duties or guarantees on preliminary findings and their refund when the investigation ends without final measures. Article 11 follows, setting the durations of provisional measures and allowing, in certain cases, final measures to be imposed retroactively for a period not exceeding 90 days before the provisional measures decision. Anyone who needs to calculate the effect of this on their shipments may consult a lawyer specialized in international matters and foreign investment.
Practical example
An importer paid provisional duties of 20% on its shipments. The final findings then established material injury and set the final duties at 15%. The final duties apply retroactively from the date of the provisional measures decision, and the difference is refunded to it. Had the final duties been 25%, the difference would not be collected from it.
