Article 30 explained in plain English
This article serves the external aim of the Law, which is to protect Saudi exporters when other countries take action against their exports. For this purpose the Authority has two tasks:
- Representation: representing the Kingdom in defending its exports in trade remedies proceedings and investigations brought by importing countries.
- Advice and technical support: for the exporters concerned by trade remedies proceedings and investigations brought against their exports by importing countries.
Under Article 1, trade remedies are the subjects of the WTO Anti-Dumping Agreement, the Agreement on Subsidies and Countervailing Measures, and the Safeguards Agreement. So if another country opens an anti-dumping, subsidy or safeguard investigation affecting a Saudi product, the exporter can find technical support at the Authority, and the Authority represents the Kingdom in those proceedings.
Note that the article speaks of "advice and technical support" and does not state that the Authority takes on the defense in every matter on the exporter's behalf.
This article comes after Article 29 on supporting Gulf investigations, and is followed by Article 31, which binds the Authority to the mandatory time limits in the Law, the Implementing Regulations and the WTO agreements, and gives it the power to communicate directly with interested parties, foreign governments and the organization, and to request and collect confidential and non-confidential information. An exporter facing an investigation abroad may consult a lawyer specialized in international matters and foreign investment.
Practical example
A Saudi petrochemicals exporter has had an anti-dumping investigation opened against it by an importing country. The company can ask the General Authority for Foreign Trade for advice and technical support, and the Authority represents the Kingdom in defending its exports in these proceedings.
