Article 29 explained in plain English
This article sets out the Authority's role when a case takes the Gulf path. Under Article 1, Gulf investigations are those conducted in accordance with the Unified Law on Anti-Dumping, Countervailing and Safeguard Measures of the GCC.
Content of the rule: the Authority coordinates and cooperates with the relevant government bodies, each within its remit, to give the necessary assistance to two parties:
- The domestic industry.
- The Technical Secretariat Office.
This is for conducting Gulf investigations, and forms of this assistance include:
- Providing the information needed to conduct Gulf investigations.
- Taking the executive steps needed to apply the measures in accordance with the Unified Law.
Under Article 1, the relevant government bodies are all government bodies in the Kingdom that the Authority determines are relevant to investigations and reviews.
The article is linked to Article 28, which allows the domestic industry to file its complaint under this Law or under the Unified Law, but not both at the same time. If the industry chooses the Gulf path, the Authority remains supportive of it. Article 30 follows, setting out the Authority's tasks in defending the Kingdom's exports. This article does not set out the procedures of the Gulf investigation itself, which are a matter for the Unified Law. Anyone following this path may consult a lawyer specialized in international matters and foreign investment.
