Article 2 explained in plain English
This article sets out the purposes for which the Law was made, which are three:
- Protecting the domestic industry from injury resulting from dumped imports and subsidized imports.
- Safeguarding against a surge in imports.
- Defending the Kingdom's exports that are subject to trade remedy measures abroad.
To understand these aims, refer to Article 1:
- Dumped imports are imports of the product under an anti-dumping investigation that are alleged or shown to be priced at dumped prices, meaning that the price at which they are exported to the Kingdom is lower than their normal value in the exporting country.
- Subsidized imports are imports of the product under a countervailing measures investigation that are alleged or shown to receive a benefit because of a specific subsidy.
- A surge in imports is an increase in imports in increasing quantities, absolute or relative to domestic production, that causes or threatens serious injury to the domestic industry.
The Law thus works in two directions: an internal one that protects producers in the Kingdom from unfair competition or a sudden influx of imports, and an external one that defends Saudi exporters when other countries take measures against their exports.
Article 3 then sets the scope of application, applying the procedures of investigations and reviews and their measures to imports from member states of the World Trade Organization under the Law and the Implementing Regulations, and giving the Governor flexibility in dealing with imports from non-member states, provided this does not conflict with the Kingdom's international commitments.
Practical example
A Saudi steel factory in Jubail notices that an imported product is being sold in the market at a price far below its price in its home country, which has harmed its sales. This kind of case is what the Law aims to address, to protect the domestic industry from dumped imports.
