Article 1 explained in plain English
This is the definitions article, which is the key to understanding the whole law, unless the context of a particular article requires another meaning. The most notable definitions are:
- Real estate finance contract: A deferred-payment contract for the beneficiary to own a home. The law therefore centers on financing home ownership.
- Beneficiary: The natural person who obtains real estate finance, that is, an individual and not a company.
- Consumer: Every person to whom real estate finance services are directed. This is broader than the beneficiary: it includes someone to whom the service is offered even if they do not obtain finance.
- Real estate financier: Commercial banks and finance companies licensed to engage in real estate finance activity.
- Subsidy-eligible person: A Saudi natural person whose income does not exceed the limit the Minister proposes from time to time and the Council of Ministers approves. The text does not state the amount of this limit.
- Housing associations: Charitable institutions and associations specialized in providing housing to those who cannot afford it, licensed under the laws.
- Primary market: Real estate finance contracts concluded between the beneficiary and the real estate financier.
- Secondary market: Trading in the financier's rights arising from primary market contracts.
The article also specifies that "the Minister" is the Minister of Finance, "the Agency" is the Saudi Arabian Monetary Agency, "the Ministry" is the Ministry of Housing, and "the Implementing Regulations" are the Implementing Regulations of the law. After it comes Article 2, which makes the Agency responsible for regulating the real estate finance sector.
