Article 17 explained in plain English
This article regulates the committee that hears violations and objections:
1- Composition and jurisdiction:
- One or more committees are formed by decision of the Board.
- Each has five members nominated by the Chairman: two legal advisers, one of whom is named chair, and three persons with technical expertise.
- It has jurisdiction to hear:
- violations of the Regulation's provisions.
- passengers' objections to the result of handling the complaints referred to in paragraph (4) of Article 15.
- In accordance with the rules the Authority sets for this purpose.
The objection meant, under Article 15, is the objection of a passenger who is not satisfied with the carrier's handling of the complaint, or where the carrier exceeded the period set for handling it, and it is submitted within sixty days of being notified of the result or of the end of the handling period.
2- Decisions and appeal: decisions are issued by majority and with reasons. An appeal against a decision may be brought before the Board of Grievances within sixty days of being notified of it.
3- Membership: its term is three years, renewable, and the Board specifies by its decision the committee's working rules and procedures, its members' remuneration and its secretariat.
The passenger's path is therefore: a complaint to the carrier, then an objection before the committee, then an appeal before the Board of Grievances. The sixty-day period for appealing to the Board of Grievances runs from the date of being notified of the committee's decision.
Article 18 provides that compensation, except in matters of injury or death, follows a policy the Authority sets, without prejudice to the right to resort to the courts.
Anyone against whom the committee has issued a decision and who wishes to appeal would be well advised to consult a lawyer specializing in administrative cases before the Board of Grievances.
Practical example
Sarah objected before the committee to the carrier's refusal to compensate her for the cancellation of her trip, and the committee issued a reasoned decision rejecting the objection, of which she was notified. If Sarah wants to appeal, she must apply to the Board of Grievances within sixty days of the date she was notified of the decision.
