Article 25 explained in plain English
The penalties in the law protect the public interest, but they do not make good the harm suffered by individuals. This article therefore recognizes the injured person's right to compensation:
- Who is entitled: anyone who suffered harm as a result of any of the violating acts provided for in the law or the regulations.
- What may be claimed: compensation for the harm.
- Where: before the competent court, which the text does not specify.
- Relationship to the penalty: the right to compensation does not affect the imposition of penalties, meaning the violator may be both punished and required to pay compensation.
The injured person may be a donor, a recipient, the heirs of a deceased person or others, as long as the harm results from an act that violates the law or the regulations. Any act that violates a provision of the law or regulations and causes harm opens the way to a claim for compensation.
The text does not state the amount of compensation or how it is assessed, which the court decides. Anyone who wishes to bring a compensation claim is best advised to consult a lawyer who specializes in civil cases and compensation.
Practical example
Ali was harmed by an act a health facility committed in breach of the Human Organ Donation Law. In addition to any penalties that may be imposed on the facility, he is entitled to bring a claim before the competent court for compensation for the harm.
