Article 22 explained in plain English
This article completes the penalty scheme by dealing with other violations for which Article 21 contains no provision:
The penalty: any act that violates a provision of the law or the regulations, and is not covered by Article 21, is punished by a fine not exceeding SAR 300,000, without prejudice to any more severe penalty in another law.
The body that imposes the penalty: not the court here, but one or more committees formed by decision of the chairman of the Saudi Health Council, on these conditions:
- The number of its members must not be less than three.
- Among them must be a Sharia or legal adviser.
- And one of the specialists in organ removal or transplant operations.
- It issues its decisions by majority.
Objection: a person against whom a fine decision is issued may object to it before the Administrative Court in accordance with the Law of Procedure before the Board of Grievances. The text does not state the objection period, which is determined from that law.
The practical difference is that the serious violations in Article 21 are heard by the criminal court, while other violations are handled by an administrative committee and its decisions are challenged before the administrative judiciary. A person against whom a decision is issued should consult a lawyer who specializes in administrative cases.
Practical example
The violations committee issued a decision fining a health facility in Dammam SAR 100,000 for violating a provision of the regulations that Article 21 does not cover. If the facility believes the decision is wrong, it may object to it before the Administrative Court.
