Article 20 explained in plain English
Although the law prohibits selling organs and any payment for donation, it does not prevent honoring and encouraging donors in an official, regulated way. This is what this article provides:
- The preparing body: the Saudi Health Council prepares a guide on the controls and requirements.
- Types of benefits: material, in-kind or moral benefits, paying incentive rewards, giving priority in work and employment, or providing study grants.
- Beneficiaries: donors, or the heirs of the deceased when they agreed to the donation.
- Timing: they are granted after the donation operation is carried out, not before it, so that they do not become a price or a conditional inducement.
- Issuance: the guide is issued by decision of the Council of Ministers.
The difference between these benefits and the prohibited payment is that they come from the State under an official, published guide, not from an agreement between the parties to the donation. The text does not set the amount of rewards or the details of priority. The guide itself will set these once issued.
It is preceded by Article 19 on waiting lists, and followed by Article 21, with which the penalty provisions begin.
Practical example
Mariam donated part of her liver to her daughter in Jeddah. After the operation she may benefit from the benefits or rewards set by the guide issued by decision of the Council of Ministers, if its controls apply to her, and this is not a prohibited sale.
