Marketing Authorization for Medical Devices in the Saudi Medical Devices Law

No medical device or supply may be circulated before registration and obtaining marketing authorization. Some devices and innovative devices are excepted from its conditions. Also the conditions for issuing a free sale certificate.

- Article 8
The article bars circulating any medical device or supply before registration and marketing authorization, and allows the Authority to exempt some of them on conditions under rules approved by the Board.
لا يجوز تداول أي جهاز أو مستلزم طبي إلَّا بعد التسجيل، والحصول على الإذن بالتسويق. وللهيئة استثناء بعض الأجهزة والمستلزمات الطبية من شرط الحصول على الإذن بالتسويق، بعد التأكد من سلامتها، وعدم استخدامها لأغراض تجارية؛ وذلك وفق قواعد يقرها المجلس.
- Article 9
The article allows the Authority to exempt an innovative medical device or supply from some marketing authorization conditions and procedures without affecting its safety and security.
للهيئة استثناء الجهاز أو المستلزم الطبي المبتكر من بعض الشروط والإجراءات اللازمة للحصول على الإذن بالتسويق؛ بما لا يؤثر في مأمونيته وسلامته عند استخدامه، وذلك وفقًا لما تحدده اللائحة.

The article refers to the Regulations the conditions needed to issue the free sale certificate for medical devices and supplies.
تحدد اللائحة الشروط اللازمة لإصدار شهادة حرية البيع.

The article refers to the Regulations the conditions and procedures for registration, issuing the marketing authorization, and for the license and its renewal, amendment, transfer and cancellation.
تحدد اللائحة الشروط والإجراءات اللازمة للتسجيل، وإصدار الإذن بالتسويق، والحصول على الترخيص وتجديده وتعديله ونقله وإلغائه.
