Article 8 explained in plain English
This article sets out how a GCC national is registered for insurance.
Where? With the competent insurance body, that is, the civil retirement or social insurance bodies.
According to which procedures? According to the procedures and forms adopted in the civil retirement or social insurance law or system of the home state of the employee or worker.
This extends the basic rule of the Law that the law of the home state governs the insurance protection of a GCC national working in another state.
Who is covered? The employee or worker "addressed by the provisions of this Law", that is, whoever meets the conditions for being subject to it. According to the definitions in Article 1:
- The employee: a person who works in the state's administrative apparatus or in public bodies subject to the civil service law of the state of the workplace.
- The worker: a person who works for a natural or legal-person employer for pay and is subject to the labor law in force.
In practical terms, the forms used for registration are those of the home state, not those of the state of the workplace. This is consistent with Article 7, which requires the body of the state of the workplace to provide employers with the insurance forms used to apply the Law.
This article does not specify who carries out the registration or its deadline; Article 9 deals with the employer's obligations in this regard.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
Practical example
An Emirati woman is hired by a government body in Riyadh. She is insured with the competent insurance body under the procedures and forms adopted in the retirement law of the United Arab Emirates, her home state.
