Article 16 explained in plain English
This article regulates what happens upon the disability, sickness or death of the employee or worker.
The steps:
- The employer notifies the retirement or insurance body in the state of the workplace of the case.
- The workplace state's body bears the burden of completing the medical reports and certificates needed to establish the disability, sickness or death.
- It sends them to the home state's body.
- They are presented to the medical committees in accordance with the rules and procedures in force in the law of the home state.
- In preparation for settling the entitlements of the employee or of those entitled through him, as the case may be, under the law of the home state.
Division of roles:
- State of the workplace: collecting the documents and reports, since it is where the case occurred.
- Home state: the medical assessment through its committees, and settling the entitlements under its law.
In practical terms, the GCC employee or his heirs do not need to start from scratch in the home state, because the workplace state's body prepares the medical file and sends it. But the medical decision and the entitlements are governed by the law of the home state.
The article sets no deadline for notification. Article 15 deals with notice of the end of service, and Article 17 with the case of a missing employee.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
Practical example
A Saudi employee working for a company in Dubai has died. The company notifies the insurance body in the United Arab Emirates, which completes the death certificate and the necessary reports and sends them to the insurance body in the Kingdom, to be presented under its procedures in preparation for settling the entitlements of his heirs under the Saudi system.
