Article 7 explained in plain English
In contrast to the obligations of the home state's body in Article 6, this article sets out the obligations of the retirement or insurance body in the state of the workplace, that is, the state in which the GCC national works.
The three obligations:
- Compulsion: taking the measures needed to oblige employers to apply the provisions of the Law.
- Awareness: taking the measures needed to make employers aware of the provisions of the Law, and providing them with the guide prepared by the home state's body and the insurance forms used.
- Follow-up: designating the body or administrative unit responsible for following up the application of the Law with its counterparts in the GCC states.
Why is the body of the state of the workplace assigned this? Because the employer is located in the state of the workplace and under the supervision of its bodies, so they are best placed to oblige and follow up the employer, whereas the home state's body is far from it.
In practical terms, an employer in the Kingdom, for example, that hires a GCC national receives awareness, the guide and the forms from the insurance body in the Kingdom, and that body is the one that obliges it to apply the Law.
The article does not specify the nature of the compulsory measures. Article 8 deals with the procedures for insuring the employee or worker under the home state's forms.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
