Article 9 explained in plain English
This article sets out the employer's role in registering a GCC employee or worker, and the sequence of steps between the bodies.
Registration steps:
- The employer in the state of the workplace is obliged to insure the employee or worker.
- It submits to the civil retirement or social insurance bodies in the state of the workplace the insurance forms for the GCC nationals working for it, after completing their details.
- These bodies notify the retirement or insurance body in the home state of the employee or worker.
The rules: this is done in accordance with the bases and rules agreed between the retirement and insurance bodies of the member states. The article does not state these bases, so they must be sought from those bodies.
The idea is that the employer does not deal directly with the body of another state, but with the body of the state in which it operates, and that body communicates with the body of the home state.
In practical terms, the company or government body that hires a GCC national is responsible for registering him and completing his forms, not the employee alone. Article 8 explains that insurance is carried out under the procedures and forms of the home state, and Article 10 deals with the workplace state's bodies keeping records and statistics on the GCC nationals working there.
To apply this to a specific case, it is advisable to consult a lawyer who specializes in social insurance and retirement laws.
Practical example
A company in Al Khobar hires a Kuwaiti engineer. The company is obliged to insure him, so it completes the insurance forms for GCC nationals and sends them to the insurance body in the Kingdom, which in turn notifies the insurance body in Kuwait.
