Article 28 explained in plain English
This article creates the violations committee, in five paragraphs:
(a) Jurisdiction and formation
- It has jurisdiction to consider violations of the Law and its Regulations, to impose penalties other than imprisonment, and to determine the amount of compensation for damage to holders of private rights.
- It consists of: a judge of a rank no lower than Judge (A), named by the Minister of Justice, as chair; a faculty member of a rank no lower than associate professor in obstetrics and gynecology, named by the Minister of Higher Education; three consultants in obstetrics and gynecology, infertility and fertilization, and premature infant pediatrics; and a legal adviser. The Minister names the consultants and the adviser.
(b) Seat: at the Ministry in Riyadh, and similar committees may be set up in regions of the Kingdom by decision of the Minister.
(c) Remuneration: set by the Council of Ministers.
(d) Rules and procedures: set by the Implementing Regulations.
(e) Imprisonment: if the committee considers that the violation warrants imprisonment, it refers the case to the Board of Grievances.
This committee therefore combines two roles: a penal role in imposing penalties other than imprisonment, and a compensatory role in determining compensation for those harmed. Note that it is chaired by a judge. Article 29 follows, setting the term of membership at three years, renewable. A person harmed by a violation at a fertility unit may consult a lawyer who specializes in health regulations.
Practical example
A woman in Jeddah is harmed by a mistake at a private fertility center. The violations committee considers the violation, imposes the appropriate penalty other than imprisonment, and determines the compensation due to her. If it considers that the violation warrants imprisonment, it refers the case to the Board of Grievances.
