Article 106 explained in plain English
This article of the Regulations regulates how to communicate with the private-right claimant in the criminal case, and obliges the administration of the court hearing the case to do two things:
- Prepare a record: for each private-right claimant, including his name, place of residence, job, phone number, and any other means of contact or information relating to him.
- Method of notification: if the court receives a notice directed to a private-right claimant:
- If he has designated a place for his notification in the town where the court is, he must be informed at that place.
- If he has not designated a place, the court administration lodges the notice in a special file prepared for that.
This shows how important it is for the private-right claimant to designate a place for his notification in the town where the court is, because not designating one means the notice is lodged in the special file instead of being communicated at a specific place.
The article does not state the legal effect of lodging the notice in the special file, so refer to the Law for that.
If you have a pending case and need advice on your specific situation, it is best to consult a lawyer who specializes in criminal cases.
Practical example
Noura filed a private-right claim within a criminal case in Riyadh, and gave the court administration an address in Riyadh for her notification. When a notice concerning her arrived, the court informed her of it at that address. Had she not given an address, the notice would have been lodged in the special file prepared for that.
