Article 105 explained in plain English
This article of the Regulations is short and works by reference. It concerns an accused who lacks full capacity, when the court appoints a guardian for him based on Article 149 of the Criminal Procedure Law, and requires the court to observe what is set in Article 104 of the Regulations.
Article 104 provides that the court hearing the criminal case appoints the guardian:
- Even if it does not have subject-matter and territorial jurisdiction over guardianship.
- With the appointment limited to the case being heard.
- And recorded in its record without issuing an instrument.
Article 104 was originally laid down for a person lacking capacity who was harmed by the crime, and Article 105 carries the same rules over to the case of an accused who lacks capacity. The result is that the guardianship the court appoints for an accused lacking capacity is for the purpose of the case being heard only, and is documented in its record without a separate instrument.
As for when the court appoints a guardian for the accused and the conditions for that, they are found in Article 149 of the Law.
If you have a pending case and need advice on your specific situation, it is best to consult a lawyer who specializes in criminal cases.
